At HOAshare, we connect homeowners, property management companies, community managers, and service vendors with robust, easy-to-use, and affordable community management software. HOAshare, LLC, and its affiliates ("HOAshare," "us," "our," or "we") respect your privacy and are committed to providing a transparent notice of our privacy practices.

This Privacy Policy (the "Policy") describes the types of information we may collect from you when you visit our website at https://www.hoashare.com/, use our mobile application, or use the services offered through the website or application (collectively, the "Platform"). This Privacy Policy applies to your interactions with us ("Communications") or your use of our websites, including www.hoashare.com, app.hoashare.com, vendors.hoashare.com, and any other websites we offer that directly link to this Privacy Policy, and your use of our products, services, and apps either online or offline (collectively, our "Services"). This Policy also covers information we collect about you from third parties or when you contact us by phone or email. This Policy describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

Throughout this Policy, "you" and "your" refer to any individual accessing the Platform, including homeowners, community members, property managers, community administrators, and service vendors. Where specific practices apply only to a particular type of user, we will say so.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. This Policy may change from time to time (see Changes to Our Privacy Policy).

Information Collection

We collect several types of information from and about you, including:

Information provided by you, such as your name, address, email address, telephone number, profile picture, and other personally identifying information. For example, we collect information from you when you subscribe to use the Platform, create an account, accept an invitation to join a community, enroll in autopay, submit a service request, list an item on the community marketplace, or communicate with other users through the Platform.
Financial information provided by you, such as bank account details for ACH payments, payment card information, and autopay preferences. Payment credentials are transmitted securely to our third-party payment processors and are not stored in plain text on our servers.
Information provided by third parties about you. As part of our services, we may also collect your name, address, email address, unit assignment, and other information about you provided by third parties, such as your homeowners' association, property management company, or our third-party payment processors.
Information uploaded by authorized users. Property managers and community administrators may upload files (such as CSV files) containing unit details, member information, and other community data through our bulk import features. This imported data is subject to the same protections described in this Policy.
Information collected automatically as you navigate through the Platform. Information collected automatically may include usage details, domain address, IP addresses, internet browser, operating system, device type and identifiers, your internet connection, the equipment you use to access the Platform, crash reports, performance diagnostics, and information collected through cookies and similar tracking technologies.

Information Use

We may use the information that we collect about you or that you provide to us:

to present the Platform and its contents to you and to improve the Platform;
to provide you with information or services that you request from us;
to fulfill our obligations to you as a subscriber and/or user of the Platform, including processing payments, generating invoices, managing recurring and autopay transactions, and maintaining financial records;
to facilitate communication between community members, property managers, and vendors through our built-in messaging system;
to provide you with notices about your account, including payment confirmations, invoice reminders, violation notices, service request updates, and community announcements;
to improve customer service and respond to your support needs;
to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for invoicing, account organization, user management, and financial reporting;
to generate financial reports, including batch reports, reconciliation records, profit and loss statements, and budget summaries for authorized administrators;
to notify you about changes to the Platform or any products or services that we offer or provide through the Platform;
to allow you to participate in interactive features on the Platform, including community announcements, events, surveys, the community marketplace, and the in-app messaging system;
to personalize your experience and better respond to your individual needs;
to enable communications to you regarding our services, such as email, text, and push notifications;
to deliver over-the-air updates and improvements to our mobile application;
to provide payment information to your HOA or property management company;
to fulfill any other purpose for which you provide it and in any other way we may describe when you provide the information; and
for any other purpose with your consent.

Disclosure of Your Information

We may disclose information that we collect about you or that you provide to us directly as described in this privacy policy:

to our subsidiaries and affiliates;
to contractors, service providers, payment processors, communication infrastructure providers, cloud hosting providers, analytics services, and other third parties we use to support our business;
to your homeowners' association and/or property management company;
to vendors connected to your community, when you submit a service request or they are assigned a work order involving your property;
to other community members, in the context of community directories, announcements, chat channels, feed posts, and marketplace listings;
to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of HOAShare's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by HOAShare about Platform users is among the assets transferred;
to fulfill the purpose for which you provide it;
for any other purpose disclosed by us when you provide the information; and
with your consent.

We may also disclose your personal information:

to comply with any court order, law, or legal process, including to respond to any government, regulatory, or law enforcement request;
to enforce or apply our Terms of Service and other agreements; and
if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of HOAshare, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may disclose aggregated information about our users and de-identified data or information that does not identify an individual.

Tracking Technologies

HOAshare uses first- and third-party cookies and other tracking technologies for various purposes, including to monitor and analyze the use of the Platform, help us provide information to you more effectively, conduct internal analytics, and provide advertising. A cookie is a unit of data stored on the user's hard drive that helps us remember you and your preferences. You can refuse cookies by turning them off in your browser. Please note, however, that if you delete or turn off cookies, you may not have access to some of the features that make your experience on our Platform smoother, you may not be able to store your preferences, and some of our services may not function properly.

Our mobile application does not use cookies but may use similar local storage mechanisms for session management and push notification delivery.

Security

We have implemented reasonable measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures include encryption of data in transit and at rest, secure authentication, role-based access controls, and regular security assessments.

Payment information is processed through PCI-compliant third-party payment processors. We do not store full payment card numbers or bank account credentials on our servers.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Data Retention and Disposal Policy

HOAshare collects and stores Personal Information for the purposes outlined in this Privacy Policy. Subject to applicable law, we retain Personal Information for as long as we continue to have a business or operational purpose to retain it and as necessary to comply with (or demonstrate compliance with) our legal or regulatory obligations, resolve disputes, prevent fraud, and enforce our rights. Please note that our retention obligations may require us to retain your Personal Information after you are no longer an Authorized User or your Company's HOAshare Account has closed. These retention obligations may also prohibit us in some cases from deleting Personal Information after you have asked us to delete your Personal Information. When the applicable retention period elapses, we will delete, de-identify, or anonymize your Personal Information in accordance with our policies and procedures.

The Platform may contain third-party links to other websites and services. Please be aware that we are not responsible for the content or privacy practices of such other third-party sites. We encourage our users to be aware when they leave our Platform and to read the privacy statements of any other site that collects personally identifiable information.

Children Under the Age of 13

The Platform is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Platform. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information to or on the Platform or through any of its features. If you believe we might have any information from or about a child under 13, please contact us in one of the ways provided in the Contact Information section below.

Your Rights and Choices

We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction and to which we are subject, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale or sharing of your personal information (as applicable). We will do our best to honor your requests subject to any legal and contractual obligations. If you would like to make a request, cancel your account or request we delete or no longer use your account information to provide you Services, contact us at support@hoashare.com or make changes to any user profile information connected to your account.

You may manage your notification preferences within the Platform settings. You may opt out of non-essential push notifications at any time through your device settings. You may enroll in or cancel autopay at any time through your account settings.

Do Not Track and Global Privacy Control

We do not respond to legacy "Do Not Track" browser signals. However, we do honor Global Privacy Control (GPC) signals. If your browser or device transmits a GPC signal, we will treat it as a request to opt out of analytics tracking, and our analytics tools will be disabled for your session accordingly.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. For material changes, we may also send you a notification through the Platform or via email. Please check back periodically to ensure you are aware of any recent updates. You can see when this page has been updated by looking at the "Last Updated" date at the top of this page.
